Polish municipalities are running out of time to adopt new general spatial plans, while offices are dealing with a record wave of applications for building condition decisions. In some places the number of requests has soared by up to 1,000 percent, adding to the pressure on overstretched planning departments.
Current studies of spatial development conditions and directions remain valid only until 31 August 2026, when general plans will take over. The deadline has been moved more than once: before settling on this date, lawmakers had pointed to 1 July and, earlier still, to 31 December 2025. Many gminas have yet to finish work on the new documents.
The general plans will determine for many years where housing can be built and where residential investment will be excluded. The biggest consequences will be felt by owners of plots without local zoning plans. Their ability to obtain a building conditions decision, known as a 'wuzetka’, will depend mainly on whether the property is located in an infill zone (OUZ) indicated in the new plan.
Offices flooded with 'wuzetka’ applications
Landowners are rushing to file requests in order to protect their investment plans, including the construction of family houses, before the new regime enters into force. Dr Łukasz Grzesiak, a town planner and head of the Spatial Planning and Construction Department in the Kłodawa commune office, told Dziennik Gazeta Prawna in June that in some locations application numbers rose by several hundred percent and in extreme cases by 1,000 percent.
Lawmakers from the Confederation party raised the issue in an interpellation to the Ministry of Development and Technology. They warned that limited staffing in municipal offices may mean some zoning proceedings will not even be started before general plans are adopted, even though landowners submitted their applications in time.
Ministry says no extra support
Deputy Minister Tomasz Lewandowski replied that the government does not plan to give gminas any extra financial or staffing support to speed up the handling of building condition applications.
One important detail helps property owners: decisions on building conditions issued before the amendment takes effect will remain valid.
