Offices besieged before key deadline. 500 PLN fine per day of delay. Changes are coming

Polish municipalities are facing a flood of applications for building permit conditions (wuzetki). At the same time, new regulations will waive penalties for delays in issuing decisions, with proceedings scheduled to be discontinued from July 1, 2026.

Local governments are struggling with a massive increase in the number of applications for zoning decisions. The government has decided to ease the consequences for municipalities by suspending the accrual of fines and ordering the discontinuation of ongoing penalty proceedings. According to information from Rzeczpospolita, the changes aim to unblock the overwhelmed administrative system.

Currently, we are dealing with a situation where the deadlines for imposing fines for delayed decisions have been suspended, and all ongoing proceedings regarding such penalties will be discontinued as of July 1, 2026 – explained Dr Agnieszka Grabowska-Toś, partner at Kania Stachura Toś Law Firm. The expert noted that property owners will lose the ability to enforce accountability for administrative delays. The instruments that allowed them to demand timely decisions have also been removed.

Wave of applications overwhelms offices

The reason for the flood of applications is the obligation for municipalities to adopt general land-use plans. The new plans may change the designated use of land, potentially blocking future investments. Fearing that their plots could lose development potential, property owners began submitting applications en masse before the plans are finalized. This clogged the offices, and officials are unable to issue decisions on time.

The penalty for each day of delay can reach 500 PLN. The lawmaker’s intervention was thus necessary to prevent municipalities from incurring huge fines while they struggle with a workload beyond their capacity.

Government intervention and its consequences

From July 1, the amendment to the Act on Planning and Spatial Development will come into force. Under its provisions, all proceedings regarding penalties for delays in issuing zoning decisions that were initiated and not finalized before the amendment takes effect will be discontinued. This means no fines will be imposed for past delays.

However, Dr Grabowska-Toś warns that property owners are now left without effective tools to pressure municipalities for faster processing. The pause in penalty accumulation effectively removes the main incentive for offices to speed up their work. Critics argue that while the change provides relief to overburdened local governments, it undermines the rights of citizens waiting for crucial building permits.
