Another claim against Mostostal Warszawa. This time regarding a hydroelectric plant

Mostostal Warszawa has received a response to its arbitration summons against GE Hydro France, with the French company filing a counterclaim for 31 million złoty. The dispute stems from the termination of a contract for the modernization of the Porąbka-Żar hydroelectric plant by PGE Energia Odnawialna.

The Polish builder submitted a request for arbitration to the International Chamber of Commerce in connection with the contract termination. In its response, GE Hydro France asked for the complete dismissal of Mostostal’s claims, arguing they are unfounded.

– In response to the arbitration summons, the respondent requested the complete dismissal of the issuer’s claims, considering them unfounded – the company said in a statement.

Counterclaims and financial demands

Alongside the request to dismiss the claims, GE Hydro France filed counterclaims. It seeks a ruling that Mostostal is responsible for the contract termination and must repay 31 million złoty in contractual penalties already paid by GE Hydro.

The French firm also wants Mostostal to accept liability for any additional penalties or damages that PGE Energia Odnawialna may seek in the future, according to the statement.

Mostostal rejects allegations

Mostostal Warszawa firmly denies the counterclaims and maintains its original position. The company stressed that it considers the French side’s arguments baseless and intended solely as a defense strategy.

– The company completely disputes the claims and allegations contained in the response to the arbitration summons, treating them as groundless and serving as a defense against the claims – the builder added.

The arbitration process is ongoing, and no date for a ruling has been set. The outcome will determine financial responsibility for the failed hydro plant modernization project.
